Fees are now set by mutual agreement. A fee agreement is established between the lawyer and their client.
(ACT No. 2015-990 of August 6, 2015).

The Different Forms of Fee Calculation

Time-Based Fees

The lawyer specifies to their clients the hourly rate they propose to apply if they choose the time-based method.

They indicate to their clients the time likely to be devoted to reviewing and handling the file. This rate may vary within the same firm depending on the cases handled. A higher hourly rate may be agreed upon in cases that warrant it.

Fixed Fees

The lawyer and their client agree on fixed, final fees. The work covered by these fees must be clearly stated.

Consultancy Fees

The lawyer may agree with his or her client to set additional success fees, which must be expressly stipulated in a prior agreement between the lawyer and his or her client, but said agreement must also include the main fees for diligence.

In the context of partial legal aid and success fees, the requirement for a fee agreement is strictly defined by law.
